Throughout these terms of use (“Terms of Use”) we use certain terms in capital letters, which are defined below. These Terms of Use apply to all users and visitors to the Platform (“Users” or “You”). Users are advised to read the contents of these Terms of Use carefully because they may impact Users' rights and obligations under the law. These Terms of Use include and should be read in conjunction with our Privacy Policy. Our Privacy Policy tells you about how we look after your personal data when you use the Platform and tells you about your privacy rights and how the law protects you. These Terms of Use may be changed, modified, supplemented or amended from time to time at our sole discretion, and without prior notice to you. You agree and accept your responsibility to check these Terms of Use periodically. The last change, amendment, addition or modification to these Terms of Use was made as of the date referenced in the “last updated on date” information above.

Definition

Except to the extent expressly provided otherwise, in these Terms of Use: “Content” means all text, photos, images, illustrations, graphics, sound recordings, videos, audio-video clips and other content that you upload, post on or through the Platform using the devices we provide to you. "Buyer" means a User who uses the Platform to view Goods and/or Services Content for the purpose of purchasing Goods and/or receiving Services offered by the Seller. “Goods” means all goods (including any part thereof) that are available for sale and published by the Seller on the Platform. "Logistics Service Provider" means a third party logistics service provider who collaborates with GameChange Solutions Pte Ltd for the delivery of Goods purchased through the Platform. “Marketing Service Provider” means a third party marketing service provider who collaborates with GameChange Solutions Pte Ltd for the marketing features provided on the Platform. “Seller” means a User who uses the Platform to display and offer Goods and/or Services to Buyers. “Breaking Party” has the meaning set out in the “Reporting Means and Procedures” section below. "Payment Service Provider" means a third party payment service provider who collaborates with GameChange Solutions Pte Ltd to process, transmit and facilitate payment methods on the Platform for payment gateway services and/or other Payment Service Providers who may be able to collaborate with GameChange Solutions Pte Ltd in the future. For the avoidance of doubt, GameChange Solutions Pte Ltd reserves its right to switch Services between service providers depending on commercial and operational performance. “Platform” means the ShopKey/ShopKey Biz website and mobile application, including any other ShopKey/ShopKey Biz technology or software that will be developed from time to time by GameChange Solutions Pte Ltd. “Services” means all services offered to be provided by the Seller or by a Third Party Service Provider on the Platform. "Third Party Service Providers" are Logistics Service Providers, Payment Service Providers, and Marketing Service Providers. The terms “GameChange Solutions”, “ShopKey/ShopKey Biz”, “we” and “our” mean GameChange Solutions Pte Ltd and, in each case, its subsidiaries and affiliates.

Acceptance of These Terms of Use

By using, visiting, accessing or viewing the Platform, you agree that you have read, understand, agree and comply with these Terms of Use and our Privacy Policy including any changes, modifications, additions and/or amendments from time to time. You understand, agree and acknowledge that these Terms of Use constitute a legally binding agreement between you and GameChange Solutions Pte Ltd and that your use of the Platform will indicate your conclusive acceptance of these Terms of Use. We may at any time release new services, tools and features on the Platform. Your use of any of our new services will be governed by these Terms of Use from the time the new service becomes available. If you do not agree with these Terms of Use, you must stop accessing or using the Platform. You agree and undertake to deactivate or delete your account from the Platform if you do not agree with these Terms of Use. You are fully responsible for all access to the Platform (including any access by others) using your account. If you use the Platform as an employee or representative of a company or organization, you represent and warrant that you are an authorized person of that company or organization or authorized to represent that company or organization, and you agree to these Terms of Use on behalf of that company or organization . You represent and warrant that you are permitted by all applicable laws and regulations to visit, or view, access or use any features, tools and/or services available on the Platform, and have the necessary legal capacity and authorization (including approval from your parent or legal guardian for Users under 21 (twenty one) years of age to bind yourself to these Terms of Use.

Account Registration, Security and Payment

Account Registration

GameChange Solutions Pte Ltd does not charge Users any registration fees.
You agree to provide true, accurate and complete information on your account, including to maintain your account at all times and ensure your payment details are always current and current.
You are solely responsible for any discrepancy or misrepresentation of the identity or information you provide in your account.
You further understand and agree that we may request additional information, verification and other requirements for your continued use of the Platform.
The Seller hereby understands that the Platform only accepts 1 (one) telephone/cellphone number to be used and registered in 1 (one) account.

Users hereby understand that when Users wish to use financial services provided by Payment Service Providers and/or other third parties, then Payment Service Providers and/or third parties may ask Users to provide or upload their personal documents on the Platform such as, but not limited to on your National Identity Card (“KTP”) and your selfie photo along with your KTP and/or other personal information required for the verification process. The purpose of this verification is to implement know your customer (KYC) carried out by Payment Service Providers in accordance with applicable laws and regulations regarding the implementation of anti-money laundering and prevention of terrorism financing for payment system service providers other than banks and non-bank foreign exchange business providers. bank.
Every User who has registered on the Platform can open an online shop and become a Seller on the Platform.
After opening their online shop on the Platform, Sellers have the right to publish and display the Goods and/or Services they offer for sale or provide in the Seller's catalog. Sellers who have registered themselves on the Platform and are eligible to open an online shop, are expected to publish Content and details of their Goods and/or Services on the Platform within 90 (ninety) calendar days from the date their online shop registration is received by us. If within the specified time period, the Seller has not published any Content on the Goods and/or Services he offers and/or no activity has been recorded on his account or online shop, then the Seller agrees and acknowledges that we have the right to make changes and/or adjustments to his online store on the Platform, including closing, deactivating, deleting or suspending the online store and/or Seller's account, without prior notice or the right to receive any compensation from us.
We may, at our sole discretion and without notice:

pre-screen, delete or change any listings related to Content, Goods and/or Services;
close, delete or suspend your account and/or online shop on the Platform;
prohibit any User from using specific features, tools and/or services available on the Platform;
terminate your access and/or block your future access to the Platform; and/or
take any and all necessary actions

against failure to comply with or against actions that violate (with or without complaints from other Users) these Terms of Use, and/or applicable law, including if transactions involving you are or are suspected of being fraudulent or misleading, or if you do not have permission and/or approvals required to sell goods and/or provide services that you offer on the Platform.

You agree not to use, or attempt to use the Platform for any purpose that is unlawful or prohibited by these Terms of Use or any applicable laws and regulations, including but not limited to:

create and/or use any hardware, software, features and/or other devices for the purpose of manipulating the Platform system or making copies of the Platform or parts of the Platform, including manipulation of (i) Content, (ii) crawling activities scraping); (iii) automation activities in transactions, buying and selling, promotions, and others; (iv) adding products to the catalogue; and/or (v) other activities that can reasonably be considered manipulative actions against the Platform system;
misuse or interfere with the operation of the Platform or servers or networks connected to the Platform, including posting, posting, transmitting, uploading, or otherwise making available any material that contains software viruses, worms, or other computer code, documents, or programs designed to interfere with, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
collect or store personal data about other Platform Users in connection with prohibited behavior and activities set out in these Terms of Use;
impersonate any person or entity, falsely state or misrepresent your affiliation with a person or entity;
remove any copyright, trademark or other intellectual property rights notices from the Platform; And
gain unauthorized access to any part or feature of the Platform, including taking any action that negatively impacts or causes inconvenience to other Users.

We have the authority to make changes to and/or delete any ratings and/or reviews made by Buyers for Seller's online stores on the Platform, if such ratings and/or reviews do not comply with these Terms of Use, including as provided in point 1 of the "Content" section. ” in these Terms of Use.
We have the authority to adjust the number of transactions or the reputation score of the Seller's online shop, or carry out the process of adjusting/closing your account, if fraud is suspected by the Seller which aims to manipulate the number of transactions they complete or increase the reputation of their online shop (such as, reviews and/or number of transactions), for example, if the Seller purchases Goods from their own online shop on the Platform using their other personal account or the personal account of another party.
Sellers are prohibited from duplicating their online stores or products on the Platform, or carrying out other actions that could be indicated as unfair competition.
Sellers have the right to change the name of their online shop and/or subdomain or their account name on the Platform in accordance with these Terms of Use. Sellers must, at all times, ensure that changes to their online store name and/or subdomain or account name on the Platform are as intended and subject to the provisions of these Terms of Use. Sellers hereby understand and acknowledge that they are fully responsible for any changes made by them to their online store name and/or subdomain or account name on the Platform. The Seller hereby agrees and acknowledges that any transactions or other legal relationships made prior to such change with the online shop name and/or subdomain or Seller's previous account name on the Platform will continue to bind the relevant Seller.

Account Security

You are personally responsible for maintaining the security and confidentiality of the information you store for your account (including the account name, your payment details and any related telephone/mobile numbers registered or associated with your account). You are fully responsible for any activity that occurs under your account, including for any losses suffered by GameChange Solutions Pte Ltd or other Users resulting from any activity that occurs under your account, including use of your account by others, or as a result from your failure to keep your account information safe and confidential.
GameChange Solutions Pte Ltd will not ask for your username or verification code (including your one-time-password (OTP) sent via short message or WhatsApp application) for any reason. Therefore, we urge you not to provide data related to your account to any party, especially to parties who claim to be or purport to act for and on behalf of GameChange Solutions Pte Ltd.
You agree to ensure that you will log out of your account after using the Platform and immediately notify us of any unauthorized use of your username, or any other breach of security. We may, at our discretion and without prior notice, delete or suspend your account to protect you, GameChange Solutions Pte Ltd from identity theft or other fraudulent activity.
You understand and agree that GameChange Solutions Pte Ltd will not be responsible for any loss or damage arising from your failure to maintain the security and confidentiality of your account, including unintended access as a result of providing your account username to third parties, borrowing your account to third parties, accessing links provided by other parties, providing or showing your one-time-password (OTP) to other parties, and any form of negligence on your part that causes losses or problems with your account on the Platform. You understand that we have no obligation whatsoever to recover your data and information stored on or as part of your account.
You understand and agree that to use the one-time-password (OTP) security feature, the relevant telecommunications service provider may from time to time charge certain fees to the User.
You have the option to permanently delete your account on the Platform by contacting our user service via the following contact:

You agree that we have no obligation whatsoever to recover your Content, data and information stored on or as part of your account.

Payment Terms

Buyers will make payments for the Goods and/or Services they wish to purchase or receive from the Seller, either by cash on delivery, transfer to a bank or electronic wallet using the payment methods available on the Platform, or other means outside the Platform as agreed between Buyer and Seller.
You understand that any payment transactions made between Sellers and Buyers outside the Platform will not be automatically recorded on the Platform.
Except for payment for Goods where the purchased Goods are sent to the Buyer by our Logistics Service Provider, all payments made by the Buyer for the purchase of Goods and/or use of Services will be sent directly to the Seller's bank account or electronic wallet.
The Buyer will only pay in cash if the Buyer wants to use the cash on delivery (COD) service. Buyers are required to pay the full amount of the Goods and/or Services purchased and cannot split the payment amount between two or more payment methods.
You understand and acknowledge that GameChange Solutions Pte Ltd is not responsible for payment claims or refunds requested by Buyers or Sellers in connection with Goods and/or Services transactions either through the Platform or outside the Platform.
You agree and acknowledge that we are not a party to any transaction or agreement between you and other Platform Users or Buyers or other parties outside the Platform. You understand that the Platform is not currently facilitated with an escrow account feature. The Buyer hereby agrees not to make any claims or demands against GameChange Solutions Pte Ltd for failure to deliver Goods and/or Services that have been paid for by the Buyer. The Buyer further agrees that GameChange Solutions Pte Ltd is not responsible for making a refund for any amount paid for Goods purchased from, and/or Services provided by, any Seller. The Seller hereby also agrees not to make any claims or demands against GameChange Solutions Pte Ltd for payments not made by the Buyer, for Goods and/or Services that have been sent or provided by the Seller to the Buyer.

You acknowledge and agree that GameChange Solutions Pte Ltd is not responsible for any loss, damage or claim that may arise from transactions, where we also have no control over the quality or accuracy of Goods and/or Services from Sellers who contract with you through the Platform , including but not limited to losses, damages or claims that may arise as a result of fraud or malicious behavior of the Seller or Buyer in a transaction.

You agree and understand that if the goods purchased are sent by a Logistics Service Provider available on the Platform, any payment made by the Buyer will only be forwarded to the Seller's bank account or electronic wallet within 12-72 hours after confirmation of delivery of the Goods by the Service Provider Related logistics. The purchase price to the Seller will be passed on after deducting shipping costs paid to the Logistics Service Provider (if any).
GameChange Solutions Pte Ltd will collaborate with Payment Service Providers in facilitating payments made on the Platform. You acknowledge and understand that GameChange Solutions Pte Ltd will not in any way withhold payments made by Buyers, nor be required to obtain any permissions necessary to process or facilitate payments. By submitting your payment information on the Platform, you authorize GameChange Solutions Pte Ltd to provide such information to our Payment Service Providers to facilitate payment. You acknowledge and understand that you may be subject to additional terms and conditions that apply to the relevant Payment Service Provider, and we advise you to review and check the terms and conditions of the relevant Payment Service Provider. You acknowledge and understand that Payment Service Providers may experience failures, issues or undesirable technical problems in forwarding, processing or transmitting payments made by Buyers to your bank account or electronic wallet. In such circumstances, you agree and undertake not to make any claims or demands against us for any and all damages and losses (including but not limited to loss of money, reputation, profits or other intangible losses) that may arise directly or indirectly due to delays in disbursement of payments.

Catalog Settings Feature

Sellers are prohibited from using catalog features (including but not limited to information display features on the Seller's online shop) as advertising or promotional media on sites, mobile applications and/or any other media used to promote their products and/or services other than the Platform. When using the catalog feature, the Seller is obliged to comply with the provisions set out in point 1 of the "Content" section in these Terms of Use. GameChange Solutions Pte Ltd reserves the right to take action for violations of the above prohibitions, including without limitation, removal of such prohibited Content and making changes to the Seller's catalogue.
Sellers are obliged to provide complete and correct information regarding the goods and/or services offered on the Platform. Any Content, samples, images, or any descriptive matter posted by the Seller and any details of the Goods or illustrations or details of the Services, contained in the Seller's catalog must be created only for the purpose of providing an overview of the Goods and/or Services described based on the facts, actual specifications and/or conditions of the Goods and Services. Sellers are not permitted to include Content, names, details, images, photos and/or text that are unrelated and/or inconsistent with the actual facts, specifications and/or conditions of the Goods and Services.
Buyers and Sellers are allowed to communicate directly on or outside the Platform about any information related to the Goods sold and/or Services offered by the Seller.
Sellers may include reference videos in their catalogs sourced from third party sites, including but not limited to YouTube and Google, but always subject to the policies of the relevant third party site organizers.
GameChange Solutions Pte Ltd reserves the right, without prior notice, to revoke subsidies or cashbacks, cancel prize benefits, reduce content and/or make changes to the Seller's online store, in the event of any violation of the provisions in point 3 of the Catalog Settings section above .
Sellers are required to categorize each Goods with different sizes and prices, and ensure that they have the necessary permits and/or approvals to sell Goods and/or provide the Services they offer on the Platform.
GameChange Solutions Pte Ltd has the right to reclaim and/or deactivate the Seller's subdomain if the Seller's account on the Platform is inactive for more than 90 (ninety) calendar days, and/or if the legal owner of the trademark (as registered/announced in the General Register of Trademarks in Indonesia) with the same subdomain name as the relevant Seller has submitted a claim to the Seller for the subdomain name.
GameChange Solutions Pte Ltd reserves the right to make any changes to the name and/or use of any Seller's online shop name and/or subdomain name for GameChange Solutions Pte Ltd's internal use, and/or if a Seller's online shop and/or subdomain name includes:

any inappropriate or offensive language. Inappropriate or offensive language includes, but is not limited to, anything that is sexually charged, abusive, defamatory, vulgar, obscene, indecent, and hateful or that contains racial, ethnic, or otherwise objectionable material of any kind ;
any images, videos or other content that in any way shows racism, discrimination, degrading, harassment, vulgarity, threats or other attitudes that are contrary to social values, norms and applicable laws and regulations as well as policies set by GameChange Solutions Pte Ltd ;
content that harasses or personally attacks others, including but not limited to unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, indecent, hateful and racially, ethnically or otherwise objectionable conduct is not permitted, or any other action that has the potential to cause conflict against individuals, groups or institutions that has the potential to give rise to unfair competition; and/or
any images of a sexual or offensive nature.

Commission

You understand that GameChange Solutions Pte Ltd may from time to time charge or apply a commission or fee for the use of any part, feature, tool or service on the Platform. You are deemed to agree and accept the commission or fees charged to you by continuing your use of certain parts, features, tools or services on the Platform.
We will notify Users of any new commission system that will be applied in the future to transactions on the Platform. Such notification will be made by, among other things, updating the provisions of these Terms of Use.
You further agree and acknowledge that any payment terms presented to you in the process of using the Platform are considered part of these Terms of Use.

Prices and Transactions

The prices of goods and services displayed on the Platform are the prices set by the Seller. Sellers are prohibited from manipulating the prices of Goods and/or Services on the Platform in any way.
Sellers are prohibited from setting unreasonable prices for the goods and/or services they offer on the Platform. GameChange Solutions Pte. reasonable as determined by the Seller.
The Buyer understands and agrees that any misinformation of the Content and other information caused by the failure of the Buyer's website or the Buyer's internet service provider to reload the Platform will be the Buyer's sole responsibility, and that the Buyer will not hold GameChange Solutions Pte Ltd liable for any This.
Seller understands and agrees that any typographical errors that cause any Content (including prices) or other information to be untrue or inaccurate are Seller's sole responsibility, and that Seller will not hold GameChange Solutions Pte Ltd liable for this. Keeping the above matters in mind, please note that if the Seller accidentally types any information about the price of their Goods and/or Services incorrectly, then the Seller has the right to refuse the order for said Goods and/or Services from the Buyer.
Users hereby understand and agree that any problems and/or conflicts arising from or related to misunderstandings between Sellers and Buyers regarding the Goods and/or Services being transacted (for example, regarding details and prices of Goods and/or Services) are not their responsibility. GameChange Solutions Pte Ltd, and the User hereby agree not to hold GameChange Solutions Pte Ltd liable for this matter.
By placing an order to purchase Goods and/or Services via the Platform, the User agrees to pay the purchase price of Goods and/or fees for Services in full, as displayed on the Platform when the ordering process is made via the Platform, where the purchase price or fees are included prices for Goods or Service fees, delivery fees and other fees that may be charged and detailed explicitly on the payment page on the Platform. The User hereby agrees to make payment of the purchase price via the payment method chosen by the User.
The platform only accepts buying and selling transactions for goods and services in Rupiah.

Shipping and Shipping Costs

The Seller hereby guarantees that all Goods and/or Services sold or offered by the Seller to the Buyer will be delivered or delivered properly based on its promise to the Buyer.
Delivery of goods from the Platform will be carried out by the relevant Seller or by a third party Logistics Service Provider that has been approved by GameChange Solutions Pte Ltd. When the Buyer places an order for Goods, the Buyer must select the available shipping option specified by the Seller and is responsible for paying the shipping costs specified for that shipping option.
You understand and acknowledge that GameChange Solutions Pte Ltd has used its best efforts to provide correct and complete information about shipping costs to Buyers, subject to the accuracy of the shipping location you specified.
However, we cannot guarantee the accuracy of location data received by our Logistics Service Providers near your delivery location. Therefore, we strongly recommend Sellers to compare the shipping costs displayed on the Platform with the shipping costs charged by the relevant Logistics Service Provider.
You agree and understand that we are not responsible, and you will not make any claims or demands against us if there is a difference between the shipping costs displayed on the Platform and the shipping costs charged by the relevant Logistics Service Provider.
You hereby understand and acknowledge that any difference in the cost of delivery of Goods is not the responsibility of GameChange Solutions Pte Ltd and you will not hold GameChange Solutions Pte Ltd liable for this, and therefore, it is at the Seller's sole discretion to choose whether to cancel or continue delivery of Goods.
For the avoidance of doubt, there are only 3 (three) options available for delivery of Goods and payment of delivery costs on the Platform, as follows:

Cash Payment on Delivery (Cash on Delivery) and Logistics Service Provider: The goods purchased will be sent to the Buyer by our Logistics Service Provider, and the Buyer will pay for the Goods by cash on delivery (cash on delivery) to the courier who delivers the Goods the. Subject to these Terms of Use, any payment made by the Buyer will only be forwarded to the Seller's bank account or electronic wallet within 12-72 hours after confirmation of delivery of the Goods by the relevant Logistics Service Provider.
Online Payment on the Platform and Self-Pickup: The Buyer will pay for the Goods directly via the payment method available on the Platform to the Seller's bank account or e-wallet, and the purchased Goods will be personally picked up by the Buyer or sent directly to the Buyer by the Seller via delivery options others outside the Platform.
Payment outside the Platform and Self-Pickup: The Buyer will pay for the Goods directly to the Seller outside of the options available on the Platform, and the Goods purchased will be personally picked up by the Buyer or sent directly to the Buyer by the Seller via other delivery options outside the Platform.

All provisions relating to the Goods delivery process are subject to the policies and authority of the Logistics Service Provider concerned.
Sellers are required to fulfill the criteria and conditions set by the Logistics Service Provider for the delivery of goods. You hereby understand and agree that any and all problems that arise in the process of sending goods by the Logistics Service Provider are the sole responsibility of the Seller and the relevant Logistics Service Provider, and must be resolved between the Seller and the relevant Logistics Service Provider. You agree not to hold GameChange Solutions Pte Ltd liable whatsoever for this matter.
If there are goods that have been sold and sent by the Seller to the Buyer which the Buyer wishes to return, then the Seller and Buyer concerned are obliged to communicate directly with each other to process the return of the Goods. GameChange Solutions Pte Ltd does not, under any circumstances, accept the return or delivery of Goods transacted between Users.
If the Goods sent by the Seller to the Buyer via our Logistics Service Provider are lost, damaged or fail to be delivered to the Buyer, then the Seller and/or Buyer concerned is required to report the problem to GameChange Solutions Pte Ltd via the reporting facilities regulated in these Terms of Use within 3×24 hours from delivery of the Goods so that they can be investigated by GameChange Solutions Pte Ltd. Notwithstanding the foregoing, the fact that GameChange Solutions Pte Ltd will provide its assistance to investigate the matter, does not mean that, in any event, GameChange Solutions Pte Ltd will be liable for the matter.
Further information about our Logistics Service Providers and applicable Goods delivery conditions is available on the websites or other marketing materials of the relevant Logistics Service Providers.

Content

When using any features and/or services available on the Platform, including for promotional purposes, installing, submitting, transmitting, uploading, storing your online shop, your Goods and/or Services or in providing any Content, you agree not to or try to For:

violates any patent rights, copyrights, trademark rights, privacy rights, publicity rights, trade secret rights, confidentiality rights, contract rights, or other rights of any individual, living or deceased, or any entity;
use inappropriate or offensive language. Inappropriate or offensive language includes, but is not limited to, anything that is sexually charged, abusive, defamatory, vulgar, obscene, indecent, and hateful or that contains racial, ethnic, or otherwise objectionable material of any kind ;
upload images, videos or other content that in any way shows racism, discrimination, degrading, harassment, vulgarity, threats or other attitudes that are contrary to social values, norms and applicable laws and regulations as well as policies established by GameChange Solutions Pte Ltd;
upload or use any content that advertises or promotes sites, mobile applications and/or other media other than the Platform;
harass or personally attack others, including but not limited to unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful and racially, ethnically or otherwise objectionable conduct is not permitted, or any other action that has the potential to cause conflict against individuals, groups or institutions that have the potential to give rise to unfair competition;
encourages illegal behavior, violates the rights of others, or violates applicable local, national or international law;
use any content to which a copyright or trademark has been attached or is protected by other applicable intellectual property rights, unless you are the owner of the material or have the appropriate license or authorization; And
displays any images of a sexual or offensive nature. GameChange Solutions Pte Ltd reserves the right to take action against violations of the above prohibitions, including without limitation, removal of such prohibited content, and blocking of the relevant Seller's account.

The User hereby understands and agrees that misuse of images or photos uploaded by the User to the Platform is the User's own responsibility.
Sellers are prohibited from posting or uploading any Content that may create any form of advertising or promotion on other sites, mobile applications and/or other media other than the Platform.
The Seller hereby represents and warrants that all Content uploaded or posted to the Platform is not categorized as prohibited content as stipulated in point 1 above or does not violate the ownership rights or intellectual property of other parties. If any Content uploaded by the Seller is found to violate the prohibitions set out in point 1 above, or if there is a report of a violation of the rights of another party submitted to GameChange Solutions Pte Ltd through the reporting facilities set out in these Terms of Use, then GameChange Solutions Pte Ltd has the right to take necessary actions to resolve such violations, including but not limited to removing such Content, and taking other actions that GameChange Solutions Pte Ltd deems necessary in its sole discretion.
By uploading or posting any Content to the Platform, you have agreed to grant GameChange Solutions Pte Ltd a non-exclusive, worldwide, perpetual, irrevocable, royalty-free and licensable (at multiple levels) right to implement any and all copyright, publicity, trademark, database rights and intellectual property rights held by the User in the Content, in any media now known or in the future.
Furthermore, to the extent permitted by applicable law, you hereby waive any moral rights to such Content and undertake not to make any claim or demand for such moral rights against GameChange Solutions Pte Ltd.
Users represent and warrant that any Content uploaded or posted to the Platform does not violate third party intellectual property rights. Each User hereby agrees to be personally responsible for any violation of third party intellectual property rights arising from any Content uploaded or posted to the Platform by the User.
Although we always strive to provide reliable information, we cannot guarantee that the Seller's catalog is always accurate and up to date, and the User hereby agrees not to hold GameChange Solutions Pte Ltd liable for any incorrect information in the catalog. The catalog may contain copyrights, trademarks or other intellectual property rights.
All Users can customize or design their own catalogs using the tools available on the Platform, including offering promotions for the sale of their Goods and/or Services. Content or materials shown or displayed on the Platform are subject to these Terms of Use and applicable laws, including applicable advertising regulations and codes of ethics.

To the extent permitted under the Google Play Store Policy and/or App Store Review Guidelines (as applicable), sales of tobacco products and/or electronic cigarettes are only permitted to be sold in the following 6 (six) categories:

GameChange Solutions Pte Ltd reserves the right to, from time to time and without prior notice, remove content selling e-cigarette products, e-cigarette devices, e-cigarette liquids, and/or products containing tobacco from the Platform, including but not limited to tobacco cigarette products , nicotine, liquid vape, mod, pod, heatstick, vaporizer and/or electronic cigarette ( e-cigarette ), referring to the policies of the Google Play Store, or any other application marketplace where the Platform may be available now or in the future ( including but not limited to the App Store, as applicable).
GameChange Solutions Pte Ltd has the right to, from time to time and without prior notice, lower the reputation of the Seller's online shop or make changes to the Seller's online shop on the Platform, if there are allegations that the Seller is manipulating the Content as mentioned in point 12 above, including but not limited to on manipulation of product names, images, descriptions, and/or other activities with the aim of manipulating the Content as referred to in point 12 above so that the Seller can continue to offer their Goods and Services through the Platform.
Users are also obliged to comply at all times with the policies and prohibitions of the Google Play Store as well as the App Store Review Guidelines and/or any other application marketplace where the Platform may be available now or in the future (as applicable) regarding prohibited and restricted content. .

List of names and addresses (mailing list) and personal information.
Goods and/or Services that insult certain parties or race(s) or can degrade the dignity of other people.
Police attributes.
Items resulting from theft.

Items that are easily explosive, flammable or combustible.
Printed or recorded material whose contents could disrupt national security, order and stability.
Cash, including foreign currency, unless the Seller has and can state a permit as a Non-Bank Foreign Currency Exchange Business Activity Operator based on Bank Indonesia Regulation No.18/20/PBI/2016 and/or other regulations related to foreign exchange.
Signal jammers, signal removers, and/or other devices that can interfere with signals or telecommunications networks.

The Seller hereby represents and warrants that all goods and/or services sold by the Seller to the Buyer on the Platform are not categorized as prohibited and/or restricted goods and/or services as specified in points 1 to 34 above. If any Goods and/or Services uploaded by the Seller are found to violate the prohibitions and/or restrictions set out in points 1 to 34 above, or if there is a report of such violation from another User which is submitted to GameChange Solutions Pte Ltd via the regulated reporting facility in these Terms of Use, then GameChange Solutions Pte Ltd has the right to take necessary actions to resolve such violations, including but not limited to removing the Goods and/or Services offered or sold on the Platform, and taking other actions deemed necessary by GameChange Solutions Pte Ltd at its sole discretion. In addition to the prohibited and/or restricted Goods and Services above, Users must also always comply with Google Play Store policies and prohibitions as well as the App Store Review Guidelines (as applicable), and any applicable laws and regulations.

Reporting Means and Procedures

For any Content uploaded by Users on the Platform including but not limited to Goods and/or Services offered or sold by Sellers or Services provided by Logistics Service Providers, Payment Service Providers, or Marketing Service Providers on the Platform that violates these Terms of Use or any applicable laws and regulations (hereinafter referred to as the "Breaking Party"), then every other User can submit a report or complaint regarding the violation to GameChange Solutions Pte Ltd via the following reporting facilities:

Reports from Users as referred to in point 1 above are submitted to GameChange Solutions Pte Ltd by including information that includes at least:

links that specifically lead to Content or Goods and/or Services that violate the prohibitions set out in these Terms of Use or any applicable laws and regulations;
the reason or basis for reporting Content or Goods and/or Services that violate the prohibitions set out in these Terms of Use or any applicable laws and regulations; And
supporting evidence relevant to the report.

Based on the report submitted by the User as referred to in points 1 and 2 above, GameChange Solutions Pte Ltd will:

check the correctness of the report and ask the reporting User to complete the requirements and/or include other additional information related to the report if necessary;
report reports from Users to the Ministry of Communication and Information of the Republic of Indonesia or related institutions if necessary;
provide notification to the Violating Party that the Content or Goods and/or Services uploaded violates the prohibitions set out in these Terms of Use or any applicable laws and regulations;
provide information regarding Violating Parties whose uploaded Content or Goods and/or Services violate the prohibitions set out in these Terms of Use or any applicable laws and regulations in the context of monitoring and/or law enforcement;
reject User reports when Content or Goods and/or Services reported, when based on GameChange Solutions Pte Ltd's assessment, do not violate these Terms of Use or any applicable laws and regulations; and/or
Violating parties whose uploaded content or goods and/or services violate these Terms of Use or any applicable laws and regulations are required to provide a response to the notification as intended in point 3 letter c above within 7 (seven) calendar days accompanied by a solution. submitted to resolve this violation problem and delete the Content or Goods and/or Services if it is proven to violate the prohibitions set out in these Terms of Use or any applicable laws and regulations. Promotions and Marketing Services

We may from time to time hold promotional activities on the Platform, whether held by ourselves or in collaboration with any third party (hereinafter referred to as "Promos"). Each Promo may be subject to different terms and conditions to other Promos, and we will make the terms and conditions for each ongoing Promo available on our Platform for Users. Users can only use 1 (one) Platform account to participate in each available Promotion. If more than 1 (one) account is registered on the Platform by 1 (one) User who has the same account information and/or the same payment identity, the User is not entitled to benefit from our Promotion.
GameChange Solutions Pte Ltd reserves the right to, without prior notification, take necessary actions, including but not limited to withdrawing subsidies or withdrawing cashback, canceling prize benefits, revoking Promotions, canceling transactions, lowering the reputation of the Seller's online shop, closing the shop online Seller or delete the User's account on the Platform, if, among other things, there is manipulation, use of invalid transaction invoices, heavy product manipulation of the product details, violations or use of Promotions for the User's personal gain, or indications of fraud or malicious behavior from Users or violations of these Terms of Use and/or applicable laws and regulations.
In the event that GameChange Solutions Pte Ltd provides a delivery fee exemption/discount promotion:

If there is a difference between the weight of an item listed in the product details and the actual weight of the item delivered by the Buyer to the Logistics Service Provider, then the amount of shipping cost subsidy that will be given refers to the information recorded by the relevant Logistics Service Provider; And
Sellers who are entitled to a shipping cost subsidy are sellers who have a valid invoice/bill. Sellers who use invalid invoices are not entitled to a shipping cost subsidy.

Sellers can use the marketing features offered on the Platform.
By using marketing features, the Seller hereby understands that GameChange Solutions Pte Ltd collaborates with Marketing Service Providers to offer these features on the Platform.
The Seller hereby agrees not to make any claims or demands against GameChange Solutions Pte Ltd for failures or losses resulting from or related to the use of marketing features provided by Marketing Service Providers on the Platform.
The Seller acknowledges and understands that the Seller may be subject to additional terms and conditions that apply to the relevant Marketing Service Provider, and we advise the Seller to review and check the terms and conditions of the relevant Marketing Service Provider.

More Guarantees

By using each feature available on the Platform, the User hereby agrees that he understands and agrees to all the terms and conditions specifically regulated for that feature.
Any other matters which are not and/or have not been specifically regulated in the terms and conditions for that specific feature will be subject to the general terms and conditions of the Platform as set out in these Terms of Use.

Warranty and Limitation of Liability

any delays or interruptions to the Platform;
delays in forwarding, processing or transmitting payments made by the Buyer to the Seller's bank account or electronic wallet;
negligence and losses incurred by the User;
quality of goods and/or services;
delivery of Goods and/or Services;
violation of any intellectual property rights;
disputes between Users;
defamation against other parties;
any misuse of the Goods or Services purchased by the Buyer;
losses resulting from unauthorized payments to other parties, who claim to act on behalf of GameChange Solutions Pte Ltd, or negligence in entering bank account numbers, electronic wallet information and/or other information, or negligence of the bank concerned;
delivery of Goods, which are covered by an official guarantee from the relevant manufacturer, to a service center. The buyer has the right to send the goods himself to the nearest service center by bringing the warranty card and purchase order;
any viruses or malware (e.g., bots, scripts, automation tools and hacking tools) obtained from access or connection to our Platform services;
any glitches, bugs, errors or inaccuracies in the Platform; any damage to your PC, laptop, mobile phone or other electronic device that you use to access our Platform, due to the use of any of the services on our Platform;

hacking carried out by any third party on the User's account.

Compensation

If you have a dispute with other Users or other third parties, including Third Party Service Providers, you hereby agree to release, discharge and indemnify GameChange Solutions Pte Ltd (including but not limited to parent companies, affiliates, subsidiaries, holders shares, directors, commissioners and employees) against any and all claims or demands for damages, expenses and losses (actual or contingent) of any kind and nature, arising from or in any way connected with such disputes, including but not limited to on losses arising from the purchase of any Goods and use of any Services as set out in the “Prohibited Goods and Services” section of these Terms of Use. Therefore, you hereby agree and expressly waive any and all legal rights and remedies based on applicable laws and regulations which will limit the scope and rights of GameChange Solutions Pte Ltd under this “Indemnification” clause.
